We are not liable for losses caused by the blockchain, smart contracts, wallets, marketplaces or other third-party services, by market price movements, or by your own actions, including approving or signing transactions and losing access to your wallet. To the extent permitted by law, our liability for indirect damages and lost profits is excluded.

9. User Account Responsibilities

If you create an account on the website, you are responsible for maintaining the security of your account, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account.

You must immediately notify oswiki.xyz of any unauthorized uses of your account or any other breaches of security. oswiki.xyz will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

10. Prohibited Activities

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  • Use the Site to advertise or offer to sell goods and services.
  • Circumvent, disable, or otherwise interfere with security-related features of the Site.
  • Engage in unauthorized framing of or linking to the Site.
  • Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.

11. Web3 Content and NFTs

The content on oswiki.xyz may include information related to Web3 technology, blockchain, NFTs, cryptocurrencies, and digital assets of the Otherside project. This information is provided for educational and informational purposes only.

The Otherside-related content, including but not limited to artwork, screenshots, character designs, descriptive text, and other intellectual property related to Otherside, belongs to the respective copyright holders. Our display of any such materials is not meant to imply any affiliation, sponsorship, or endorsement by the owners of these properties.

12. Trading, Transactions and Fees

oswiki.xyz is a non-custodial platform. We never take custody of your funds, NFTs, or private keys. When you connect a wallet, sign a message, or approve a transaction, you do so directly with your own wallet and the underlying blockchain, and you are solely responsible for those actions.

Listing, buying, and transferring NFTs occur on public blockchains and are final and irreversible once confirmed. We do not control the blockchain, gas fees, network conditions, or third-party marketplaces and smart contracts, and we cannot reverse, cancel, or refund a confirmed transaction. Transactions may fail, revert, or be delayed for reasons outside our control, and any resulting costs (including gas) are your responsibility.

Wallets and login providers (for example MetaMask, WalletConnect, Glyph and Privy) and external marketplaces are third-party services governed by their own terms. We do not operate them and are not responsible for their security, availability, or for losses caused by them.

A marketplace fee may be applied to trades facilitated through oswiki.xyz; the applicable fee is shown before you confirm a transaction. Interacting with NFTs, cryptocurrencies, and smart contracts carries inherent risk, including the total loss of value. Nothing on oswiki.xyz is financial, investment, or legal advice, and you are responsible for your own due diligence.

13. User-Generated Content

Some areas of oswiki.xyz let you submit content, such as community guides. You retain ownership of the content you create, but by submitting it you grant oswiki.xyz a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content in connection with operating and promoting the platform.

You are solely responsible for the content you submit, and you confirm that you have the rights to share it and that it does not infringe the rights of others or violate any law. We may review, edit, remove, or decline to publish any user-submitted content at our discretion and without notice. This section governs user-submitted content; the intellectual property rights in oswiki.xyz's own materials remain as described above.

14. AI Features

oswiki.xyz may offer features powered by artificial intelligence. AI-generated responses can be inaccurate, incomplete, or out of date and are provided for informational purposes only. They do not constitute financial, investment, or legal advice, and you should independently verify any information before relying on it.

15. Paid Plans and Credits

Some features, such as higher AI limits, are available through paid plans (monthly or yearly) or one-time credit packs. Prices are shown before purchase; VAT may apply. Card payments are processed by Stripe; payments in APE are made on-chain.

Subscriptions paid by card renew automatically at the end of each billing period until cancelled. You can cancel at any time in your account; access continues until the end of the paid period and no further charges are made. Upgrades take effect immediately and are billed pro rata; downgrades take effect at the next billing period. APE payments are one-time payments for the selected period and do not renew automatically.

Purchased credits do not expire and are used after your plan's included monthly allocation. Credits have no cash value and cannot be transferred. Except as required by law or described in section 16, payments are non-refundable.

16. Right of Withdrawal (EU Consumers)

If you are a consumer in the EU, you generally have the right to withdraw from a purchase within 14 days without giving a reason. Paid plans and credits are digital services and content that we provide immediately. Before purchase you expressly request immediate activation and acknowledge that you lose your right of withdrawal once the plan or credits are activated.

Where a right of withdrawal still applies, you can exercise it by sending a clear statement to [email protected] within 14 days of purchase. We will refund the payment within 14 days, less a proportionate amount for the service already provided.

17. Communities, Badges and Raffles

Communities on oswiki.xyz are run by their own admins, who are responsible for their community's content, badges, eligibility rules and raffles. We host these features and may moderate, suspend or remove communities, badges or content that violate these terms or the law.

Badges are free collectibles without a guaranteed value. Raffles are free to enter, prizes are offered by the respective community, and there is no legal claim to winning or to receiving a prize. We may cancel a claim or raffle in case of abuse, technical errors or manipulation.

18. Governing Law

These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. The courts of Vienna, Austria have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may also bring proceedings in the courts there.
